Terms and Conditions of Hire

Definitions:

“Hiree" means the customer, organisation or company that has hired the equipment, attraction or entertainment with Huff n Puff Castles and Events.

“Self-supervision” means the hire of the booked equipment, attraction or entertainment for the “Hiree” to  operate and supervise the use of themselves.

“Staffed” hire means the hire of the booked equipment, attraction or entertainment accompanied by a staff supervisor from Huff n Puff Castles and Events to supervise the use of the equipment, attraction or entertainment.

Insurance and Liability:

Huff n Puff Castles and Events 5m public liability insurance policy covers the use of the equipment whilst on staffed hire only. We strongly recommend that insurance be arranged to cover Public Liability if the equipment is hired on a self-supervision basis.

Equipment hired on a self-supervision basis is not covered by our insurance policy. It is the responsibility of      the Hiree to ensure adequate insurance cover for third party liability, theft and damage to the equipment.

Huff n Puff Castles and Events liability shall be limited to a refund of any monies paid for unforeseen insurmountable circumstances that prevent us from fulfilling our obligations to supply equipment. In the event of a delayed start Huff n Puff Castles and Events liability shall be limited to a pro rata reduction in the hire fee. No additional compensation payment will be made for loss of earnings or any other consequential loss.

Booking terms:

No booking shall be deemed to be confirmed until the signed hire agreement and deposit payment is received. Equipment will only be reserved for a period of 7 days from date of enquiry. Booking deposits are non refundable. Cancellations due to bad weather will result in full loss of deposit unless an alternative booking is found.

All cancellations or changes in booking must be notified in writing.
Cancellations will be charged as follows:

28 days notice or more loss of the deposit paid.
14-28 days notice 50% of the total hire fee is payable.
Less than 14 days notice 100% of the total hire fee is payable.

Payment made by cheque or BACS must be received 7 days prior to the event date. Where balance payments are due on delivery, equipment will not be put on site until payment in cash or debit/credit card is made.

Clients with approved account facilities terms are strictly 30 days from invoice date. Huff n Puff Castles and Events reserve the right to charge 2% above Its bank interest rate on overdue accounts.

Once an order has been received whether the Hiree has booked by telephone, email or otherwise, has returned a signed hire agreement and or deposit or not, the Hiree is deemed to have read, fully understood and fully agree to the terms and conditions of hire.

General Hire Terms:

All equipment on hire or loan shall remain the property of Huff n Puff Castles and Events or their suppliers.

All equipment will be delivered and set up to one location on the site as agreed and cannot be moved or relocated once unloaded.

All equipment is used entirely at the Hiree own risk, whether or not the equipment is staffed or self-supervision run.

Huff n Puff Castles and Events may refuse to install the equipment if upon arrival the site is found to be unsuitable, or failure to notify in writing that the installation location is excessive from our delivery vehicle, or failed written notification of delivery obstacles such as stairs, or insufficient width and height clearance for the equipment hired in such a case the full hire fee will be due payable.

The Hiree is responsible for providing a safe electricity supply within 50 metres of the site for the equipment if required unless generators have been hired.

The Hiree must ensure that:
a) Access is clear to the site and available at the stated time of delivery;
b) The proposed area on the site is sufficient in width, length, and height to safely accommodate the hired     equipment;  
c) The Hiree or representative at the time of delivery is aware of the positioning of the equipment and has   access to all necessary points to ensure the safe installation of the equipment,
d) The proposed operating site for the equipment is clear of any obstacles that may prove to be a
hazard for the safe operation of the equipment,
e) The Hiree or representative has the authority to make payment, sign for delivered equipment and receive any safety operating instructions.

Any fault not reported at the time of delivery will be deemed to be the responsibility of the Hiree.

Hires on a self-supervision basis the Hiree is fully responsible for the equipment including it's safe use. The hiree agrees to reimburse Huff n Puff Castles and Events fully for the cost of replacement of equipment due to damage or loss; repairs to damaged equipment; or the cost of cleaning due to excessive soiling or staining including face paints or sand whilst on hire to the hiree.

Where equipment needs to be delivered through buildings it is the Hiree responsibility to ensure that any fittings, furnishings or other items are removed or covered with protective material. Huff n Puff Castles and Events or their suppliers cannot be held responsible for any damage to fittings or furnishings, however caused, although every precaution is taken.

Once equipment is installed it must not be moved, have items added to, be altered in any way or used for any other purpose other than that which it has been designed for, without the written permission from Huff n Puff Castles and Events

The Hiree is responsible for ensuring that adequate first aid facilities are available if necessary.

For equipment hired on a self-supervision basis the Hiree is responsible for ensuring that all safety regulations are enforced and that equipment is constantly supervised as per the operating instructions issued.

No sub-letting of equipment is permitted without the written authorisation of Huff n Puff Castles and Events.

For equipment hired on a self-supervision basis the Hiree is responsible for ensuring that the equipment is not used in inclement weather conditions. In the event of heavy rain or winds exceeding 38km/h (Force 5 Beaufort Scale), the unit should be deflated immediately and then re inflated once the winds or rain subsides. Beaufort Scale description = Fresh Breeze – Small trees in leaf begin to sway.

The Hiree is responsible for ensuring that any special licences or permission for use of hired equipment are obtained as necessary.

The Hiree is responsible for ensuring that adequate security and crowd control measures and barriers are in place prior to the event commencement.

In the event of equipment failure or breakdown Huff n Puff castles and Events must be informed immediately. The Hiree must not attempt to effect repairs. Whilst every effort will be made to rectify the problem, Huff n Puff Castles and Events or their suppliers cannot be held liable for any losses whatsoever for equipment failure or breakdown whilst on hire.

Huff n Puff Castles and Events reserve the right to withdraw any equipment or services from the site if our staff supervisors asses that the conduct of guests and or clients constitute a danger or risk the safety to themselves, other guests and or clients at the event, our staff supervisors or the equipment. Huff n Puff Castles and Events operate a zero tolerance policy for verbal or physical abuse of its staff. No refund will be given and the full hire fee will be due whether the equipment has been temporally or permanently withdrawn.

Huff n Puff Castles and Events reserve the right to replace any equipment booked to the Hiree without notice or refund with similar type equipment and value should the reserved equipment become unserviceable due to damage or loss sustained prior to the hire booking.
